Hukuka ayk\u0131r\u0131 tahliye yap\u0131lamaz; kirac\u0131y\u0131 zorla \u00e7\u0131karmak, kap\u0131 kilidini de\u011fi\u015ftirmek, elektri\u011fi-su kesmek gibi davran\u0131\u015flar su\u00e7tur ve ciddi yapt\u0131r\u0131mlar\u0131 vard\u0131r. Tahliye ancak: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>TBK\u2019da belirtilen \u015fartlar olu\u015ftu\u011funda, <\/li>\n\n\n\n<li>\u0130cra dairesi yoluyla, <\/li>\n\n\n\n<li>Veya mahkeme karar\u0131yla yap\u0131labilir.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131n\u0131n Tahliyesi Hangi Durumlarda M\u00fcmk\u00fcnd\u00fcr? <\/h2>\n\n\n\n<p>Kirac\u0131 tahliyesi belli ba\u015fl\u0131 6 hukuki nedenle ger\u00e7ekle\u015febilir:<\/p>\n\n\n\n<p><strong>Kira Bedelinin \u00d6denmemesi <\/strong><\/p>\n\n\n\n<p>Kirac\u0131n\u0131n kira bedelini zaman\u0131nda \u00f6dememesi en s\u0131k g\u00f6r\u00fclen tahliye nedenidir. Kiraya veren, \u00f6denmeyen kira i\u00e7in noterden ihtar g\u00f6nderir ve kirac\u0131ya en az 30 g\u00fcn s\u00fcre verir. <\/p>\n\n\n\n<p>Bu s\u00fcrede \u00f6deme yap\u0131lmazsa tahliye davas\u0131 a\u00e7\u0131labilir veya icra yoluyla tahliye talep edilebilir. Ayn\u0131 kira y\u0131l\u0131nda iki hakl\u0131 ihtar g\u00f6nderilmi\u015fse, kiraya veren ayr\u0131ca tahliye davas\u0131 a\u00e7ma hakk\u0131 elde eder.<\/p>\n\n\n\n<p><strong>S\u00f6zle\u015fmeye Ayk\u0131r\u0131 Davran\u0131\u015f <\/strong><\/p>\n\n\n\n<p>Kirac\u0131n\u0131n a\u015fa\u011f\u0131daki fiilleri tahliye nedeni olu\u015fturur: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Evde izinsiz tadilat yapmak <\/li>\n\n\n\n<li>Kom\u015fular\u0131 rahats\u0131z etmek <\/li>\n\n\n\n<li>Evde yasa d\u0131\u015f\u0131 faaliyet y\u00fcr\u00fctmek <\/li>\n\n\n\n<li>Kiralanan\u0131 amac\u0131 d\u0131\u015f\u0131nda kullanmak <\/li>\n\n\n\n<li>Kira s\u00f6zle\u015fmesini \u00fc\u00e7\u00fcnc\u00fc ki\u015filere izinsiz devretmek<\/li>\n<\/ul>\n\n\n\n<p> Bu durumlarda kiraya veren ihtar g\u00f6ndererek kirac\u0131ya uyar\u0131da bulunur. Devam etmesi h\u00e2linde tahliye davas\u0131 a\u00e7\u0131labilir.<\/p>\n\n\n\n<p><strong>Tahliye Taahh\u00fctnamesi <\/strong><\/p>\n\n\n\n<p>Kirac\u0131n\u0131n belirli bir tarihte kendi el yaz\u0131s\u0131yla veya noterde d\u00fczenlenmi\u015f belgeyle ta\u015f\u0131nmaz\u0131 bo\u015faltmay\u0131 taahh\u00fct etmesi h\u00e2linde, kiralayan taahh\u00fct tarihinden itibaren 1 ay i\u00e7inde icra yoluyla tahliye talep edebilir. Bu y\u00f6ntem en h\u0131zl\u0131 tahliye yollar\u0131ndan biridir.<\/p>\n\n\n\n<p><strong>Kiraya Verenin Konut veya \u0130\u015f Yeri \u0130htiyac\u0131 <\/strong><\/p>\n\n\n\n<p>Kiraya veren; <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kendisi, <\/li>\n\n\n\n<li>E\u015fi, <\/li>\n\n\n\n<li>\u00c7ocuklar\u0131, <\/li>\n\n\n\n<li>Anne veya babas\u0131 <\/li>\n<\/ul>\n\n\n\n<p>i\u00e7in ta\u015f\u0131nmaza ihtiya\u00e7 duydu\u011funu samimi ve zorunlu \u015fekilde ispatlarsa tahliye davas\u0131 a\u00e7abilir. Bu duruma ihtiya\u00e7 nedeniyle tahliye denir.<\/p>\n\n\n\n<p><strong>Yeniden \u0130n\u015fa ve Esasl\u0131 Tadilat <\/strong><\/p>\n\n\n\n<p>Kiralayan ta\u015f\u0131nmazda b\u00fcy\u00fck bir tadilat, g\u00fc\u00e7lendirme veya komple yeniden in\u015fa yapacaksa kirac\u0131y\u0131 tahliye edebilir. Ancak bu s\u00fcre\u00e7te tadilat\u0131n ger\u00e7ekten gerekli oldu\u011funun teknik raporlarla ispatlanmas\u0131 gerekir.<\/p>\n\n\n\n<p><strong>Kira S\u00f6zle\u015fmesinin S\u00fcresinin Bitmesi <\/strong><\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesi s\u00fcre bitiminde kendili\u011finden sona ermez. Kiraya verenin kendili\u011finden tahliye yapmas\u0131 yasakt\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131n\u0131n Haklar\u0131 Nelerdir? <\/h2>\n\n\n\n<p>Kirac\u0131 tahliye s\u00fcrecinde g\u00fc\u00e7l\u00fc haklara sahiptir: <\/p>\n\n\n\n<p><strong>a) Haks\u0131z tahliyeye kar\u015f\u0131 itiraz <\/strong><\/p>\n\n\n\n<p>\u0130cra takibine 7 g\u00fcn i\u00e7inde itiraz edebilir. <\/p>\n\n\n\n<p><strong>b) Fahi\u015f kira art\u0131\u015f\u0131na kar\u015f\u0131 dava <\/strong><\/p>\n\n\n\n<p>Kiraya veren fahi\u015f zam yaparak kirac\u0131y\u0131 \u00e7\u0131karmaya zorlayamaz. <\/p>\n\n\n\n<p><strong>c) Tahliye sonras\u0131 tazminat <\/strong><\/p>\n\n\n\n<p>\u0130htiya\u00e7 nedeniyle tahliye ger\u00e7ekle\u015fmi\u015fse, kiraya veren 3 y\u0131l boyunca ta\u015f\u0131nmaz\u0131 ba\u015fkas\u0131na kiralayamaz. Aksi h\u00e2lde kirac\u0131 tazminat isteyebilir. <\/p>\n\n\n\n<p><strong>d) G\u00fcvence (Depozito) iadesi <\/strong><\/p>\n\n\n\n<p>Kiraya veren, tahliye sonras\u0131 herhangi bir zarar yoksa depozitoyu iade etmek zorundad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kiraya Verenin Haklar\u0131 Nelerdir? <\/h2>\n\n\n\n<p>Kiraya veren de \u00e7e\u015fitli hukuki imkanlara sahiptir: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kiran\u0131n g\u00fcn\u00fcnde ve tam al\u0131nmas\u0131n\u0131 talep etme <\/li>\n\n\n\n<li>Ta\u015f\u0131nmaz\u0131n amac\u0131na uygun kullan\u0131lmas\u0131n\u0131 isteme <\/li>\n\n\n\n<li>S\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k durumunda ihtar ve tahliye talebi <\/li>\n\n\n\n<li>Gerekti\u011finde tazminat isteme<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Uyu\u015fmazl\u0131klar\u0131n \u00d6nlenmesi \u0130\u00e7in \u00d6neriler <\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kira s\u00f6zle\u015fmesi mutlaka yaz\u0131l\u0131 yap\u0131lmal\u0131d\u0131r. <\/li>\n\n\n\n<li>Kirac\u0131n\u0131n t\u00fcm bilgileri ve kefil \u015fartlar\u0131 s\u00f6zle\u015fmede yer almal\u0131d\u0131r. <\/li>\n\n\n\n<li>Tahliye taahh\u00fctnamesi s\u00f6zle\u015fme s\u0131ras\u0131nda de\u011fil, daha sonra verilmelidir. <\/li>\n\n\n\n<li>Kira \u00f6demeleri mutlaka banka \u00fczerinden yap\u0131lmal\u0131d\u0131r. <\/li>\n\n\n\n<li>S\u00f6zle\u015fmeye y\u0131ll\u0131k zam oran\u0131, kullan\u0131m amac\u0131 ve tahliye \u015fartlar\u0131 net eklenmelidir.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">SONU\u00c7 <\/h2>\n\n\n\n<p>Kirac\u0131 tahliyesi, hukuki a\u00e7\u0131dan titizlikle y\u00fcr\u00fct\u00fclmesi gereken bir s\u00fcre\u00e7tir. T\u00fcrk Bor\u00e7lar Kanunu kirac\u0131y\u0131 korusa da, kira bedelinin \u00f6denmemesi, tahliye taahh\u00fcd\u00fc, ihtiya\u00e7, tadilat ve s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k gibi belirli durumlarda kiraya veren tahliye talep edebilir. <\/p>\n\n\n\n<p>Tahliye i\u015flemleri mutlaka hukuka uygun, ihtarname ve mahkeme\/ icra s\u00fcrecine dayanarak yap\u0131lmal\u0131d\u0131r. Aksi h\u00e2lde kirac\u0131 tazminat isteyebilir. d) G\u00fcvence (Depozito) iadesi Kiraya veren, tahliye sonras\u0131 herhangi bir zarar yoksa depozitoyu iade etmek zorundad\u0131r. Kiraya Verenin Haklar\u0131 Nelerdir? Kiraya veren de \u00e7e\u015fitli hukuki imkanlara sahiptir: Uyu\u015fmazl\u0131klar\u0131n \u00d6nlenmesi \u0130\u00e7in \u00d6neriler SONU\u00c7 Kirac\u0131 tahliyesi, hukuki a\u00e7\u0131dan titizlikle y\u00fcr\u00fct\u00fclmesi gereken bir s\u00fcre\u00e7tir. T\u00fcrk Bor\u00e7lar Kanunu kirac\u0131y\u0131 korusa da, kira bedelinin \u00f6denmemesi, tahliye taahh\u00fcd\u00fc, ihtiya\u00e7, tadilat ve s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k gibi belirli durumlarda kiraya veren tahliye talep edebilir. Tahliye i\u015flemleri mutlaka hukuka uygun, ihtarname ve mahkeme\/ icra s\u00fcrecine dayanarak yap\u0131lmal\u0131d\u0131r.
