A\u015fa\u011f\u0131da bu s\u00f6zle\u015fmenin taraflar\u0131 olan arsa sahibi ve y\u00fcklenici (m\u00fcteahhit) a\u00e7\u0131s\u0131ndan haklar, y\u00fck\u00fcml\u00fcl\u00fckler ve dikkat edilmesi gereken noktalar detayl\u0131 \u015fekilde ele al\u0131nm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kat Kar\u015f\u0131l\u0131\u011f\u0131 \u0130n\u015faat S\u00f6zle\u015fmesinin Temel \u00d6zellikleri <\/h2>\n\n\n\n<p>Kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi; proje, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm listesi, teslim s\u00fcresi, cezai \u015fartlar, iskan, ruhsat s\u00fcre\u00e7leri, maliyet payla\u015f\u0131m\u0131 gibi \u00e7ok say\u0131da kriteri i\u00e7eren kapsaml\u0131 bir hukuki belgedir. <\/p>\n\n\n\n<p>Taraflar s\u00f6zle\u015fmeyi imzalad\u0131ktan sonra, y\u00fcklenici projeyi tamamlama sorumlulu\u011funu \u00fcstlenirken, arsa sahibi de arsas\u0131n\u0131n kullan\u0131m hakk\u0131n\u0131 belirli \u00f6l\u00e7\u00fclerde devretmi\u015f olur. <\/p>\n\n\n\n<p>Bu s\u00fcre\u00e7 ortakl\u0131k ili\u015fkisine benzedi\u011fi i\u00e7in taraflar kar\u015f\u0131l\u0131kl\u0131 haklara ve sorumluluklara sahiptir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Arsa Sahibinin Haklar\u0131 <\/h2>\n\n\n\n<p><strong>a) S\u00f6zle\u015fmeye Uygun Ba\u011f\u0131ms\u0131z B\u00f6l\u00fcmlere Hak Kazanma <\/strong><\/p>\n\n\n\n<p>Arsa sahibi, in\u015faat tamamland\u0131\u011f\u0131nda s\u00f6zle\u015fmede belirtilmi\u015f ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin kendisine verilmesini talep edebilir. Bu hak, y\u00fcklenicinin projeyi zaman\u0131nda ve eksiksiz tamamlamas\u0131yla do\u011far. <\/p>\n\n\n\n<p><strong>b) \u0130n\u015faat S\u00fcrecini Denetleme Hakk\u0131 <\/strong><\/p>\n\n\n\n<p>Arsa sahibi, in\u015faat\u0131n s\u00f6zle\u015fme, proje ve ruhsata uygun yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131 denetleyebilir. Bu kapsamda teknik bilirki\u015filerden rapor alabilir. <\/p>\n\n\n\n<p><strong>c) Teslim ve Kalite Talep Hakk\u0131 <\/strong><\/p>\n\n\n\n<p>M\u00fcteahhit s\u00f6zle\u015fmede belirtilen malzeme kalitesi ve teknik \u015fartnameye uygun \u00fcr\u00fcnler kullanmak zorundad\u0131r. Arsa sahibi eksik imalat, ay\u0131pl\u0131 i\u015f\u00e7ilik veya kalite d\u00fc\u015f\u00fckl\u00fc\u011f\u00fc tespit etti\u011finde m\u00fcdahale edebilir. <\/p>\n\n\n\n<p><strong>d) Gecikme Tazminat\u0131 \u0130steme Hakk\u0131 <\/strong><\/p>\n\n\n\n<p>\u0130n\u015faat\u0131n s\u00fcresinde tamamlanmamas\u0131 h\u00e2linde arsa sahibi s\u00f6zle\u015fmeye konulan gecikme cezas\u0131n\u0131 talep edebilir.<\/p>\n\n\n\n<p><strong>e) Tapu \u0130\u015flem G\u00fcvencesi Hakk\u0131 <\/strong><\/p>\n\n\n\n<p>Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler teslim edildi\u011finde, arsa sahibi kendi paylar\u0131n\u0131n tapu devrini alma hakk\u0131na sahiptir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Arsa Sahibinin Sorumluluklar\u0131 <\/h2>\n\n\n\n<p><strong>a) Arsay\u0131 S\u00f6zle\u015fmeye Uygun \u015eekilde Teslim Etmek <\/strong><\/p>\n\n\n\n<p>Arsa \u00fczerinde ipotek, haciz, \u015ferh gibi engeller varsa, arsa sahibi bunlar\u0131 kald\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n<p><strong> b) Y\u00fcklenecek Paylar\u0131 Zaman\u0131nda Devretmek <\/strong><\/p>\n\n\n\n<p>S\u00f6zle\u015fmede belirtilen oranda arsadan pay devri yap\u0131lmal\u0131d\u0131r. Bu devrin yap\u0131lmamas\u0131 in\u015faat\u0131 durdurabilir. <\/p>\n\n\n\n<p><strong>c) \u0130n\u015faata M\u00fcdahale Etmemek <\/strong><\/p>\n\n\n\n<p>Arsa sahibi proje s\u00fcrecine teknik veya hukuki a\u00e7\u0131dan gereksiz m\u00fcdahalelerde bulunamaz. M\u00fcdahale eder ve s\u00fcre\u00e7 aksarsa, sorumluluk do\u011far.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Y\u00fcklenicinin (M\u00fcteahhidin) Haklar\u0131 <\/h2>\n\n\n\n<p><strong>a) Arsadan Pay Alma Hakk\u0131 <\/strong><\/p>\n\n\n\n<p>Y\u00fcklenici, in\u015faat\u0131 tamamlamas\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda s\u00f6zle\u015fmede belirlenen ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere hak kazan\u0131r. <\/p>\n\n\n\n<p><strong>b) \u0130n\u015faata Ba\u015flama ve Kullanma Hakk\u0131 <\/strong><\/p>\n\n\n\n<p>Y\u00fcklenici, in\u015faat ruhsat\u0131 \u00e7\u0131karma, \u015fantiye kurma, ta\u015feron firmalarla \u00e7al\u0131\u015fma gibi t\u00fcm operasyonel haklara sahiptir. <\/p>\n\n\n\n<p><strong>c) Proje ve Mimar\u00ee D\u00fczenlemeleri Yapma Yetkisi <\/strong><\/p>\n\n\n\n<p>S\u00f6zle\u015fmeye uygun olmak kayd\u0131yla y\u00fcklenici in\u015faat\u0131n teknik detaylar\u0131 \u00fczerinde tasarrufta bulunabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Y\u00fcklenicinin Sorumluluklar\u0131 <\/h2>\n\n\n\n<p><strong>a) \u0130n\u015faat\u0131 S\u00f6zle\u015fmeye Uygun \u015eekilde Tamamlama <\/strong><\/p>\n\n\n\n<p>Proje, ruhsat ve teknik \u015fartnameye uygun yap\u0131 in\u015fa edilmezse y\u00fcklenici hukuken sorumlu olur. <\/p>\n\n\n\n<p><strong>b) Zaman\u0131nda Teslim <\/strong><\/p>\n\n\n\n<p>Teslim s\u00fcresinin a\u015f\u0131lmas\u0131 h\u00e2linde gecikme cezalar\u0131 ve tazminatlar g\u00fcndeme gelir. <\/p>\n\n\n\n<p><strong>c) Kalite Standartlar\u0131na Uyma <\/strong><\/p>\n\n\n\n<p>Eksik veya ay\u0131pl\u0131 imalattan do\u011fan t\u00fcm zararlar\u0131 y\u00fcklenici kar\u015f\u0131lamak zorundad\u0131r. <\/p>\n\n\n\n<p><strong>d) Ruhsat, \u0130skan ve Resm\u00ee S\u00fcre\u00e7lerden Sorumluluk <\/strong><\/p>\n\n\n\n<p>Projenin ruhsat ve iskan i\u015flemleri y\u00fcklenicinin sorumlulu\u011fundad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Taraflar\u0131n Ortak Hak ve Y\u00fck\u00fcml\u00fcl\u00fckleri <\/h2>\n\n\n\n<p>Kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi taraflar aras\u0131nda uzun vadeli bir ortakl\u0131k etkisi yarat\u0131r. Bunlar\u0131 \u00f6nlemek i\u00e7in: <\/p>\n\n\n\n<p><strong>a) S\u00f6zle\u015fme Noterde D\u00fczenleme \u015eeklinde Yap\u0131lmal\u0131 <\/strong><\/p>\n\n\n\n<p>Adi yaz\u0131l\u0131 s\u00f6zle\u015fmeler ileride ge\u00e7ersiz say\u0131labilir. <\/p>\n\n\n\n<p><strong>b) Teknik \u015eartname Ayr\u0131nt\u0131l\u0131 Olmal\u0131 <\/strong><\/p>\n\n\n\n<p>Hangi malzemenin kullan\u0131laca\u011f\u0131, teslim kalitesi, ortak alanlar, otopark gibi unsurlar net belirtilmelidir. <\/p>\n\n\n\n<p><strong>c) Ba\u011f\u0131ms\u0131z B\u00f6l\u00fcm Listesi ve Pay Oranlar\u0131 Kesinle\u015fmi\u015f Olmal\u0131 <\/strong><\/p>\n\n\n\n<p>Taraflar hangi dairelerin hangi tarafa ait olaca\u011f\u0131n\u0131 ba\u015ftan bilmelidir. <\/p>\n\n\n\n<p><strong>d) Cezai \u015eart Maddesi Konulmal\u0131 <\/strong><\/p>\n\n\n\n<p>\u00d6zellikle teslim gecikmeleri i\u00e7in belirli bir g\u00fcnl\u00fck ceza oran\u0131 yaz\u0131lmal\u0131d\u0131r. <\/p>\n\n\n\n<p><strong>e) \u0130n\u015faat S\u00fcrecinde D\u00fczenli Raporlama Yap\u0131lmal\u0131 <\/strong><\/p>\n\n\n\n<p>Y\u00fcklenici arsa sahibine ayl\u0131k ilerleme raporu sunmal\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sonu\u00e7 <\/h2>\n\n\n\n<p>Kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi, hem arsa sahibi hem de m\u00fcteahhit a\u00e7\u0131s\u0131ndan ciddi hak ve y\u00fck\u00fcml\u00fcl\u00fckler do\u011furan karma\u015f\u0131k bir hukuki ili\u015fkidir. <\/p>\n\n\n\n<p>Bu s\u00f6zle\u015fmenin profesyonelce haz\u0131rlanmas\u0131, hem hukuki hem de finansal riskleri b\u00fcy\u00fck \u00f6l\u00e7\u00fcde azalt\u0131r. <\/p>\n\n\n\n<p>Taraflar\u0131n hak ve sorumluluklar\u0131n\u0131 net belirlemesi, teknik detaylar\u0131n s\u00f6zle\u015fmede yer almas\u0131 ve s\u00fcrecin \u015feffaf y\u00fcr\u00fct\u00fclmesi ba\u015far\u0131l\u0131 bir proje i\u00e7in kritik \u00f6nem ta\u015f\u0131r. <\/p>\n\n\n\n<p>Bu nedenle s\u00f6zle\u015fme haz\u0131rlan\u0131rken mutlaka <strong><a href=\"https:\/\/www.ibrahimkaya.av.tr\/gaziantep-gayrimenkul-avukati\/\">gayrimenkul avukat\u0131 <\/a><\/strong>hukuk dan\u0131\u015fman\u0131, s\u00fcre\u00e7 boyunca ise mimari ve teknik uzmanlardan destek al\u0131nmas\u0131 \u00f6nerilir.<\/p>\n\n    <div class=\"xs_social_share_widget xs_share_url after_content \t\tmain_content  wslu-style-1 wslu-share-box-shaped wslu-fill-colored wslu-none wslu-share-horizontal wslu-theme-font-no wslu-main_content\">\n\n\t\t\n        <ul>\n\t\t\t        <\/ul>\n    <\/div> \n","protected":false},"excerpt":{"rendered":"<p>Kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi, arsa sahipleri ile m\u00fcteahhitler aras\u0131nda yap\u0131lan ve \u00fclkemizde en \u00e7ok tercih edilen gayrimenkul geli\u015ftirme modellerinden biridir. Arsa Sahibinin Haklar\u0131 a) S\u00f6zle\u015fmeye Uygun Ba\u011f\u0131ms\u0131z B\u00f6l\u00fcmlere Hak Kazanma Arsa sahibi, in\u015faat tamamland\u0131\u011f\u0131nda s\u00f6zle\u015fmede belirtilmi\u015f ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin kendisine verilmesini talep edebilir. Bu hak, y\u00fcklenicinin projeyi zaman\u0131nda ve eksiksiz tamamlamas\u0131yla do\u011far. b) \u0130n\u015faat S\u00fcrecini Denetleme Hakk\u0131 Arsa sahibi, in\u015faat\u0131n s\u00f6zle\u015fme, proje ve ruhsata uygun yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131 denetleyebilir. Bu kapsamda teknik bilirki\u015filerden rapor alabilir. c) Teslim ve Kalite Talep Hakk\u0131 M\u00fcteahhit s\u00f6zle\u015fmede belirtilen malzeme kalitesi ve teknik \u015fartnameye uygun \u00fcr\u00fcnler kullanmak zorundad\u0131r. Arsa sahibi eksik imalat, ay\u0131pl\u0131 i\u015f\u00e7ilik veya kalite d\u00fc\u015f\u00fckl\u00fc\u011f\u00fc tespit etti\u011finde m\u00fcdahale edebilir. d) Gecikme Tazminat\u0131 \u0130steme Hakk\u0131 \u0130n\u015faat\u0131n s\u00fcresinde tamamlanmamas\u0131 h\u00e2linde arsa sahibi s\u00f6zle\u015fmeye konulan gecikme cezas\u0131n\u0131 talep edebilir. e) Tapu \u0130\u015flem G\u00fcvencesi Hakk\u0131 Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler teslim edildi\u011finde, arsa sahibi kendi paylar\u0131n\u0131n tapu devrini alma hakk\u0131na sahiptir. Y\u00fcklenicinin Sorumluluklar\u0131 a) \u0130n\u015faat\u0131 S\u00f6zle\u015fmeye Uygun \u015eekilde Tamamlama Proje, ruhsat ve teknik \u015fartnameye uygun yap\u0131 in\u015fa edilmezse y\u00fcklenici hukuken sorumlu olur. b) Zaman\u0131nda Teslim Teslim s\u00fcresinin a\u015f\u0131lmas\u0131 h\u00e2linde gecikme cezalar\u0131 ve tazminatlar g\u00fcndeme gelir. c) Kalite Standartlar\u0131na Uyma Eksik veya ay\u0131pl\u0131 imalattan do\u011fan t\u00fcm zararlar\u0131 y\u00fcklenici kar\u015f\u0131lamak zorundad\u0131r. d) Ruhsat, \u0130skan ve Resm\u00ee S\u00fcre\u00e7lerden Sorumluluk Projenin ruhsat ve iskan i\u015flemleri y\u00fcklenicinin sorumlulu\u011fundad\u0131r.
