Ancak bu davalar sadece \u201cfahi\u015f zam\u201d ya da \u201cd\u00fc\u015f\u00fck kira\u201d gerek\u00e7esiyle de\u011fil, kanuni s\u0131n\u0131rlar \u00e7er\u00e7evesinde a\u00e7\u0131labilir. <\/p>\n\n\n\n<p>Bir avukat g\u00f6z\u00fcyle, kira tespit davas\u0131 yaln\u0131zca yasal haklar\u0131n de\u011fil, ayn\u0131 zamanda dikkatli bir haz\u0131rl\u0131\u011f\u0131n ve do\u011fru zamanlaman\u0131n da sonucudur. <\/p>\n\n\n\n<p>Kira tespit davas\u0131n\u0131n nas\u0131l a\u00e7\u0131laca\u011f\u0131, kimlerin a\u00e7abilece\u011fi, hangi belgelerin gerekti\u011fi ve s\u00fcrecin g\u00fcncel yasal durumunu detayl\u0131ca inceleyece\u011fiz.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira Tespit Davas\u0131 Nedir? <\/h2>\n\n\n\n<p>Kira tespit davas\u0131, kiraya verenin (mal sahibinin) veya kirac\u0131n\u0131n mahkemeden kira bedelinin adil, rayi\u00e7 de\u011fere uygun bi\u00e7imde yeniden belirlenmesini talep etti\u011fi davad\u0131r. Bu, mahkemede sunulacak bilirki\u015fi raporuna destek sa\u011flar. <\/p>\n\n\n\n<p><strong>2. Yetkili Mahkeme <\/strong><\/p>\n\n\n\n<p>Yetkili mahkeme, kiralanan\u0131n bulundu\u011fu yer Sulh Hukuk Mahkemesi\u2019dir. <\/p>\n\n\n\n<p><strong>4. Dava A\u00e7\u0131lmas\u0131 ve Tebligat S\u00fcreci <\/strong><\/p>\n\n\n\n<p>Dilek\u00e7e sunulduktan sonra kar\u015f\u0131 tarafa (\u00f6rne\u011fin kirac\u0131ya) tebligat yap\u0131l\u0131r. Karar ve Uygulama <\/strong><\/p>\n\n\n\n<p>Mahkeme, belirlenen yeni kira bedelini gelecek kira d\u00f6nemi ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olmak \u00fczere h\u00fckme ba\u011flar. Bu, ilerleyen s\u00fcre\u00e7te ciddi delil sorunlar\u0131na yol a\u00e7ar. Kira tespit davalar\u0131 hukuki gerek\u00e7elerle a\u00e7\u0131lmad\u0131\u011f\u0131nda, davalar uzun s\u00fcrer ve bazen reddedilir. Kira tespit davas\u0131n\u0131 her y\u0131l a\u00e7abilir miyim? <\/strong><\/p>\n\n\n\n<p>Hay\u0131r.
